Terms of Service

These Terms of Service ("Terms") are an agreement between you and Fritts Films LLC, a Texas limited liability company ("we", "us", "our"), about your use of YGOBox. Please read them. They include an agreement to settle disputes through individual arbitration instead of in court, which you can opt out of (section 16).

By creating an account, buying Booster, or otherwise using YGOBox, you agree to these Terms. If you do not agree, do not use YGOBox. Our Privacy Policy explains what personal data we collect and how we use it.

1. Who we are

YGOBox is a collection manager for the Yu-Gi-Oh! Trading Card Game. It is made and run by Fritts Films LLC, Dallas, Texas, USA. You can reach us at [email protected].

In these Terms, "YGOBox" or "the Service" means all of the following, together with the emails and support we provide with them:

  • the website at ygobox.com;
  • the web app at app.ygobox.com and our API at api.ygobox.com;
  • the YGOBox apps for computers and phones;
  • the YGOBox Scanner apps for iPhone and Android.

2. Who can use YGOBox

  • You must be at least 13 years old.
  • If you live in the European Economic Area (EEA), the United Kingdom or Switzerland, you must be at least 16, unless a parent or guardian agrees to your use of YGOBox and to these Terms on your behalf.
  • If you are under the age of majority where you live (18 in most places), a parent or guardian must agree to these Terms for you, and only an adult may buy Booster.
  • You may not use YGOBox if the law that applies to you forbids it, or if we closed an account of yours before for breaking these Terms.

We do not knowingly let children under 13 create an account. If we learn that an account belongs to a child under 13, or to someone under 16 in the EEA, the UK or Switzerland without a parent's or guardian's agreement, we will delete it.

3. Your account

  • The web app, sync between devices, sharing and Booster need an account. The YGOBox apps for computers and phones can also be used without one, with everything kept on the device.
  • Use an email address that you control. We use it to sign you in and to send you account and security emails.
  • Keep your password secret and do not reuse one from another service. We recommend turning on two-factor authentication in Settings > Account.
  • You are responsible for what happens under your account. If you think someone else has got into it, change your password and tell us right away at [email protected].
  • An account is for one person. Do not share, sell or transfer it.
  • If you choose a public handle, it must not impersonate anyone, mislead people about who you are, infringe someone else's rights, or be offensive. We may clear a handle that breaks these rules.

4. The Service

YGOBox lets you record the cards you own, where they are stored and what they are worth, build decks, keep wants lists and lists, track graded cards, import and export your data, sync it between your devices and share parts of it if you choose.

  • Information may be wrong. Card information, prices, collection values, format legality and scanner results are provided for convenience. They can be incomplete, out of date or wrong. Check anything that matters to you, for example before you buy, sell or trade a card or register a deck for a tournament.
  • The web app needs an internet connection. The apps for computers and phones keep working offline and sync when they are back online.
  • YGOBox changes. We keep improving YGOBox, so features may be added, changed or removed. Some features may be marked as a preview or beta; they may be less reliable than the rest. If we remove something that Booster subscribers pay for, we will tell them in advance.
  • Keep your own copies. We work hard to keep YGOBox available and your data safe, but we cannot promise that the Service will never be interrupted or that data will never be lost. You can download a complete backup at any time (Settings > Maintenance > Backup) and export your collection (Collection > Export).

5. Free plan and Booster

  • Free plan. Every feature, up to the card cap shown in the app (currently 500 active collection rows). At the cap you cannot add new rows, but editing, moving, selling, exporting and deleting keep working, and nothing is removed.
  • Booster is our paid plan. It removes the card cap and may include other extras we describe in the app. The price is shown before you buy.

Buying Booster on the web

On the web, Booster is sold through Stripe's Managed Payments service. For these purchases Stripe, with its Link service, acts as the merchant of record: it is the seller in the transaction, takes your payment, charges and pays any sales tax or VAT, sends your receipts and handles payment questions, and its own terms apply to the purchase. Your card statement shows a Link or Stripe descriptor, such as "LINK.COM* YGOBOX". Prices are shown in your currency at checkout, including any tax that applies. You can manage or cancel a web subscription from Settings > Account ("Manage subscription").

Buying Booster in the apps

In the phone apps, Booster is sold through the Apple App Store or Google Play. Apple or Google takes the payment, their terms apply to the purchase, and you manage, cancel or ask for a refund in your Apple or Google account settings. We cannot cancel or refund a store purchase for you.

Renewal and cancellation

  • Booster renews automatically at the end of each billing period (a month or a year) and the payment method on file is charged the price at that time, until you cancel.
  • You can cancel at any time. Canceling stops the next renewal; Booster keeps working until the end of the period you already paid for.
  • If a free trial is offered, its length is shown at checkout. Unless you cancel before the trial ends, it becomes a paid subscription.
  • If we change the price, we will tell you in advance by email or in the app. The new price applies from your next renewal after the notice, and you can cancel before then.
  • Except where the law requires otherwise, or the seller's own policy (Stripe's, Apple's or Google's) provides for it, payments are non-refundable and there are no refunds or credits for part of a billing period.
  • If you are a consumer in the EEA, the UK or Switzerland, you may have a right to cancel a purchase within 14 days under your local law. How that right works for a purchase is explained by the seller at checkout (Stripe on the web, Apple or Google in the apps). Nothing in these Terms takes that right away.
  • When Booster ends you are back on the free plan. Nothing is deleted; if your collection is above the cap you just cannot add new rows until it is below it again.
  • We may offer promotion codes, and we may give Booster free of charge to testers or others. Those are subject to any conditions stated with them.

Deleting your account while you pay

If your subscription still renews, cancel it first; YGOBox will not delete an account whose subscription is still set to renew. If paid time is left, we schedule the deletion for the end of that time and your account keeps working until then, or you can choose to delete the account at once and give up the rest of the paid time, without a refund. Deleting an account never cancels or refunds a payment by itself.

6. Acceptable use

When you use YGOBox, do not:

  • break the law, or help anyone else break it;
  • scrape, crawl or bulk-download YGOBox, including card data, images, prices or other people's public pages, or access YGOBox with bots or other automated means, except through the export and backup features we offer;
  • reverse engineer, decompile or disassemble YGOBox, or use our API other than through our own apps and websites, except to the extent the law allows this despite this restriction;
  • get around the card cap, rate limits, payment, access controls or any other limit or security measure;
  • probe, scan or test our systems for weaknesses, or break into them (if you find a security problem, please tell us at [email protected] instead);
  • overload, disrupt or interfere with YGOBox or other people's use of it;
  • get into another person's account or data without their permission;
  • upload viruses or other harmful code;
  • put anything illegal, infringing, hateful, harassing, sexually explicit or threatening into custom cards, notes, names of decks, lists, locations or other items, photos, your handle, or anything you share or make public;
  • impersonate anyone, or mislead people about who you are;
  • resell, rent or sublicense YGOBox, offer it as a service to others, or use it or its data to build a competing product or data set;
  • use card data or prices from YGOBox in a way that breaks the terms of the sources they come from (section 8).

7. Your content

"Your content" is everything you put into YGOBox: your collection and its details, decks, wants lists, lists, storage locations, notes, custom cards, photos, scans, your handle and your settings.

  • You own your content. We do not claim ownership of it.
  • What you allow us to do with it. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, back up, transmit, process, sync and display your content, and to make technical changes to it (such as converting formats or resizing photos), only as needed to run, secure and improve YGOBox for you and as you direct. When you make an item public or share a link to it, this license includes showing it to anyone who opens that page or link. Public pages may be found through search engines.
  • When that ends. The license ends when you delete the content or your account, except for copies in our backups and in the encrypted archive of a deleted account, which expire as the Privacy Policy describes, and except for copies other people already made of what you shared publicly (for example, a public deck someone copied into their own decks).
  • Your responsibility. You must have the rights to what you upload (for example, photos) and it must follow these Terms. You are responsible for what you choose to make public.
  • What we may do. We do not review content before it is saved, but we may hide or remove content, or clear a handle, that we reasonably believe breaks these Terms or the law.
  • Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

8. Third-party data and services

YGOBox brings together information and services from others. We provide it as it comes, without any promise that it is accurate or complete.

  • Card data. Card names, text, sets, rarities and images come from community sources, including YGOProDeck and Yugipedia. They belong to their respective owners and are subject to those sources' own terms and licenses.
  • Prices. Prices are from third-party marketplaces, which are not affiliated with YGOBox. They are market estimates, not offers to buy or sell, and may be delayed, missing or wrong. Values shown for your collection are estimates. Nothing in YGOBox is financial or investment advice.
  • PSA. If you add your own PSA API token, your device contacts PSA directly with it to look up your graded cards. PSA's terms govern that use. The token and what PSA returns stay on your device; they do not go to our servers.
  • Scanner results. YGOBox Scanner identifies cards automatically and can get a card, printing or condition wrong. Check a batch before you add it to your collection.
  • Other services. Payments are handled by Stripe, Apple and Google, and YGOBox may link to other websites. Their terms and privacy policies apply to them, and we are not responsible for them.

9. Our rights and trademarks

  • YGOBox, including its software, design, text, name and logo, belongs to Fritts Films LLC and its licensors. Some parts are open-source software, which is covered by its own license.
  • We give you a personal, limited, non-exclusive, non-transferable and revocable license to use YGOBox for your own collection, as these Terms allow. Do not use the YGOBox name or logo in a way that suggests we endorse you, without our written permission.
  • YGOBox is not affiliated with or endorsed by Konami, Shueisha, Studio Dice, or NAS. Card images and names are property of their respective owners. We use the name of the game only to describe what YGOBox works with.

If you believe that something on YGOBox (for example, a public page) infringes your copyright, email [email protected] with:

  • your name, address, phone number and email address, and your physical or electronic signature;
  • the work you believe is infringed;
  • the material you believe infringes it and where it is on YGOBox (for example, the page address);
  • a statement that you believe in good faith that the use is not authorized by the owner, its agent or the law; and
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or are authorized to act for the owner.

If we remove your content because of a notice and you believe that was a mistake, you can send us a counter-notice. We close the accounts of people who repeatedly infringe.

11. Closing your account

  • You can stop using YGOBox at any time and delete your account in Settings > Account, or by writing to us from your account's email address. The Privacy Policy explains what is deleted and what we keep. Section 5 explains what happens to paid time.
  • We may suspend or close your account, or limit what it can do, if you seriously or repeatedly break these Terms, if it is needed to protect YGOBox, our users or others, or if the law requires it. Where it is reasonable we will tell you why beforehand and give you a chance to fix the problem or export your data. We will not do so where that would be unlawful or would put others or an investigation at risk.
  • If we stop offering YGOBox altogether, we will tell you at least 30 days before, where we can, so you can export your data.
  • Sections 7 (the parts about copies and feedback), 8, 9 and 12 to 20 continue to apply after your account is closed.

12. Disclaimers

YGOBOX IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT YGOBOX WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT DATA WILL NEVER BE LOST, OR THAT CARD DATA, PRICES, VALUES, LEGALITY INFORMATION OR SCANNER RESULTS ARE ACCURATE OR COMPLETE.

Some places do not allow some of these exclusions, so they may not all apply to you. Section 15 explains how this section applies to consumers in the EEA, the UK and Switzerland.

13. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

  • NEITHER WE NOR OUR MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS OR SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR THE VALUE OF CARDS OR COLLECTIONS, ARISING OUT OF OR RELATING TO YGOBOX OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE; AND
  • OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YGOBOX OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR YGOBOX IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM, AND (B) US$50.

Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, for gross negligence or wilful misconduct, or for anything else that the law does not allow to be limited.

14. Indemnity

To the extent the law allows, you agree to defend, indemnify and hold harmless Fritts Films LLC and its members, managers, employees and contractors from any third-party claim, and the costs and liabilities that come with it (including reasonable legal fees), arising from your content, your breach of these Terms, or your violation of the law or of someone else's rights. This section does not apply to consumers where the law does not allow it.

15. Consumers in the EEA, the UK, Switzerland and elsewhere

If you are a consumer and live in the EEA, the UK, Switzerland or another country whose consumer laws give you rights that a contract cannot take away, nothing in these Terms limits those rights. Sections 12, 13, 14, 16 and 17 apply to you only as far as those laws allow. In particular, you keep your statutory rights for digital content and digital services, and we are responsible for foreseeable loss or damage that we cause by breaking these Terms or by failing to use reasonable care and skill.

16. Disputes: arbitration and class-action waiver

Please read this section carefully. It affects your legal rights, including your right to go to court.

16.1 Talk to us first. Most problems can be solved quickly. Before starting an arbitration or court case, you and we each agree to send the other a written description of the dispute and what you or we want (to us at [email protected]; to you at your account's email address) and to try in good faith to settle it. If it is not settled within 60 days of that notice, either of us may start an arbitration.

16.2 Agreement to arbitrate. You and we agree that any dispute, claim or controversy arising out of or relating to these Terms or YGOBox, including questions about whether this section applies or can be enforced, will be settled by binding individual arbitration instead of in court, except as described in section 16.3. The Federal Arbitration Act governs the interpretation and enforcement of this section.

16.3 Exceptions. Either of us may (a) bring an individual claim in small claims court if it qualifies and stays there, and (b) ask a court for an injunction or other equitable relief to stop the infringement or misuse of copyrights, trademarks, trade secrets, patents or other intellectual property.

16.4 How arbitration works. The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. If the AAA is not available, we will agree on another provider, or a court will appoint one. Any hearing will take place by video or telephone, or in person in the county where you live or in Dallas County, Texas, as you choose. The payment of fees is governed by the AAA's rules, under which we pay most of the fees for a consumer claim. The arbitrator may award the same individual relief as a court could, but only to the individual party asking for it and only as far as needed for that party's individual claim.

16.5 No class actions and no jury. YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT COMBINE MORE THAN ONE PERSON'S CLAIMS. YOU AND WE BOTH GIVE UP THE RIGHT TO A JURY TRIAL. If a court decides that this section 16.5 cannot be enforced for a particular claim or type of relief, that claim or relief (and only that) will be decided in court, after the individual arbitration of everything else is finished.

16.6 You can opt out. You can opt out of this agreement to arbitrate within 30 days after you first accept these Terms (or, if you already had an account, within 30 days after you first accept a version of these Terms that contains this section). To do so, email [email protected] from your account's email address with the subject "Arbitration opt-out", your name, and a clear statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.

16.7 Changes to this section. If we make a material change to this section, you may reject it by emailing us within 30 days after the change takes effect. The earlier version of this section will then continue to apply between us.

16.8 EEA, UK and Swiss consumers. This section 16 does not take away any right you have, as a consumer in the EEA, the UK or Switzerland, to bring a claim in the courts of the country where you live or to rely on the mandatory consumer protection law of that country. Where your local law gives you that right, you may use it instead of arbitration.

17. Governing law and courts

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, and the Federal Arbitration Act governs section 16. Any dispute that is not arbitrated (because of an exception in section 16.3 or an opt-out) will be heard only in the state or federal courts located in Dallas County, Texas, and you and we agree to their jurisdiction. If you are a consumer in the EEA, the UK or Switzerland, you also keep the protection of the mandatory laws of the country where you live, and you may bring proceedings in its courts.

18. Changes to these Terms

The version and effective date of these Terms are shown at the top. We may update them, for example when YGOBox changes or the law does.

  • If a change is material, meaning it substantially affects your rights or obligations, we will tell you in advance by email or in YGOBox and ask you to accept the new Terms before you continue to use your account. If you do not accept them, you can export your data and delete your account.
  • Other changes, such as corrections or clearer wording, take effect when we publish them with a new date.
  • A change does not apply to a dispute about something that happened before the change took effect.

You can ask us for an earlier version of these Terms at any time.

19. Apps from the Apple App Store and Google Play

If you got a YGOBox app from the Apple App Store:

  • these Terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content;
  • your license to the app lets you use it on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions;
  • Apple has no obligation to provide maintenance or support for the app;
  • if the app fails to meet any warranty that applies, you may tell Apple and Apple will refund the purchase price you paid for the app, if any; to the maximum extent the law allows, Apple has no other warranty obligation for the app;
  • Apple is not responsible for dealing with any claim by you or anyone else about the app or your use of it, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws;
  • if someone claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim;
  • you confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties;
  • you must comply with any third-party terms that apply when you use the app (for example, your mobile data plan); and
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you as a third-party beneficiary.

If you got a YGOBox app from Google Play, the Google Play Terms of Service also apply to your download and to purchases made through Google Play.

20. General

  • Entire agreement. These Terms, the Privacy Policy and any terms shown to you when you buy Booster are the whole agreement between you and us about YGOBox.
  • Transfer. We may transfer these Terms to a company that takes over YGOBox, for example after a sale or reorganization, and we will tell you if that happens. You may not transfer them without our written agreement.
  • If a part is invalid. If a court decides that part of these Terms cannot be enforced, the rest stays in effect.
  • No waiver. If we do not enforce a part of these Terms straight away, we can still enforce it later.
  • Events beyond our control. We are not responsible for delays or failures caused by events we cannot reasonably control, such as outages at our providers, natural disasters or attacks.
  • Notices. We send notices to your account's email address or show them in YGOBox. You can send notices to [email protected] or by post to the address in section 21.
  • Sanctions and export laws. You may use YGOBox only as allowed by US and other applicable sanctions and export control laws.
  • Language. These Terms are written in English. If we provide a translation and it differs, the English version applies, unless the law where you live says otherwise.
  • No other beneficiaries. Except as stated in section 19, these Terms do not give rights to anyone other than you and us.
